These General Conditions of Use and Contracting (henceforth, the ‘Conditions’) apply to the contracting and use of the services offered through the FUNDACIÓ GRAN TEATRE DEL LICEU websites (www.liceubarcelona.cat and www.liceuplus.cat). Henceforth, 'the website'. For more information on how personal data are processed, please visit the Privacy Policy section, and for more information about cookies, please visit the Cookies Policy section. Before accessing and using the website to contract services, please carefully read and accept these Conditions. If you do not wish to accept them, do not access or use this service. If you contract services, you are accepting these Conditions and the Privacy and Cookies Policies.

IDENTIFICATION OF THE CONTRACTING PARTIES These Conditions are signed by the LICEU and by the ticket purchaser (the user), whose details they provided to the website, in particular via the registration form that the LICEU has made available for this purpose. A user is any person or legal entity who acquires, uses or enjoys any of the services offered by the LICEU or via the website or who registers as a user of the website.
PURPOSE The purpose of these Conditions is to regulate browsing of the website and the services offered therein, as well as the purchase process and the subsequent relationship between the LICEU and the spectators. The LICEU reserves the right to unilaterally amend these Conditions in order to adapt them to current regulations, to correct any material errors that are detected, to comply with resolutions issued by competent authorities or to make these Conditions clearer and/or more impartial. Notwithstanding the fulfilment of contracts already signed, the duty to provide notification of the change of the Conditions is considered fulfilled by publication of the amendments on the website. The LICEU reserves the right to amend the goods and services offered on the website (services, prices, promotions and other commercial and service conditions).
POSITION OF THE FUNDACIÓ GRAN TEATRE DEL LICEU Through its website, the LICEU offers tickets, season tickets and complementary services for shows and performances in the different halls of the GRAN TEATRE DEL LICEU and on the Liceu+Live platform. Tickets for shows and performances are subject to availability, and their promotion on the website under no circumstances implies a guarantee of availability. If circumstances require it, the LICEU reserves the right to change the dates, times, programmes or performers announced, as well as to cancel the performance. Once a ticket has been purchased, the amount cannot be exchanged or refunded, unless the event is cancelled, in which case the LICEU shall refund the ticket price. However, if the cancellation is due to unforeseen circumstances or force majeure, the user will not be entitled to a refund of the ticket price.
USE OF THE CONTRACTING SERVICE The FUNDACIÓ GRAN TEATRE DEL LICEU's online booking service must only be used by people over the age of eighteen (18) or the minimum legal age. The user acknowledges that he/she is of legal age and that he/she has the necessary legal capacity and ability to act in order to contract to the services offered by the LICEU. By contracting online, the user acknowledges and accepts that they are using the website or application and/or undertaking the contracting process at their own risk. The user is obliged to use the contracting service in accordance with the law, morality, public order and these Conditions. Likewise, users are obliged to use the service appropriately and not to carry out illegal activities or activities that constitute a crime, that infringe upon the rights of third parties or that violate any legal order. The website and/or the contracting process may include contents, information or links to third parties or third party websites. The LICEU is not responsible for the content of these websites or for the content of any third party promotion or sponsorship or for compliance with these regulations. Users may access these links at their own risk, and the LICEU is not responsible for and does not guarantee the content, completeness or accuracy of these links or the websites to which they refer. The user agrees to exonerate the LICEU from any liability resulting from the use of these links.
NEED TO REGISTER To use the contracting services, users must register on the website and create a personal account. The user accepts the obligation to provide true, accurate and complete information about their identity and legitimacy. He/she accepts and understands that he/she is directly and exclusively responsible for the authenticity, accuracy, validity and truthfulness of the data provided, since the LICEU does not have the means to verify and does not verify the identity of the user, notwithstanding its check of the correctness and suitability of these data. In case of error when entering the data, the user may correct them by sending an e-mail to rgpd@liceubarcelona.cat. The data provided are those needed to provide the services contracted or subscribed through the website. If the user provides any false, inaccurate or incomplete information, or if the LICEU has reasonable grounds to doubt the truthfulness, accuracy or completeness of this information, the LICEU may deny the user access and/or present or future use of the website or any of its contents and/or services. The account will give access to a private area where he/she can manage transactions related to the LICEU, consult and/or modify the personal information linked to the account at any time and check all the transactions that he/she has carried out with the LICEU linked to that account. The user is solely responsible for safeguarding his/her access identification data (username and password), as well as for choosing and providing a sufficiently secure password and maintaining confidentiality by not disclosing it or communicating it to unauthorised third parties. The identification data must always be linked to a valid email address. It is the user’s responsibility to notify the FUNDACIÓ GRAN TEATRE DEL LICEU of any incident in the email account that may affect the services. Transferring the user account or the benefits that may derive from the purchase of tickets to third parties is forbidden, as is reselling FUNDACIÓ GRAN TEATRE DEL LICEU tickets to third parties.
CONTRACTING PROCESS Once registration is complete, the user must log in to complete the process of purchasing tickets, subscriptions or complementary services. Access to the contracting process is completely free of charge and has no additional associated costs. Each service offered is described in detail in the show's schedule, which will always be available to customers in the 'Programming' section. The form will include the updated information on the functions, and the user should consult the information indicated when they are contracting the service. In the case of Liceu+Live, the show's ticket will include updated information about the performances and the characteristics of the broadcast. The announcement on the website is a firm and binding offer of sale that the user accepts when he/she clicks on the ‘Buy’ or ‘Subscribe’ button. The act of filling in the different forms before clicking on the ‘Buy’ or ‘Subscribe’ button and the explicit acceptance of these Conditions implies a clear and direct expression of the user's desire to contract them. Once the offer is accepted, the contract is formalised, and the parties acquire the rights and obligations stemming therefrom. The LICEU will store the electronic document in which the contract is formalised on a durable support, which will be made available to the client by means of an email confirming the purchase, which the user may store digitally or print out. The contracting procedure shall be carried out in Catalan, Spanish or English, depending on the language chosen by the user. The default language of the procedure will be Catalan.
PRICE, RATES AND PAYMENT The prices or rates of the tickets, subscriptions or services offered on the website will be expressed in euros and will include the corresponding VAT. The prices in force at the time of the contract can be consulted at any time and prior to payment. The prices may fluctuate and the user should not rely on a price other than the one expressed on the day of the contract. The price will also be visible in the e-mail confirming the purchase. The price of the ticket will not be reflected in purchases sent as a ‘gift’, which the user has the option to manage directly. Payments of the operations conducted via the website can be made through the following payment methods VISA, MASTERCARD and AMEX. The purchase will be effective for the LICEU once it has received confirmation of the purchase from the bank. If the purchase process is interrupted for any reason or if the amount paid does not reach the corresponding amount (including administrative costs and bank charges), the LICEU will suspend the process and inform the customer.
VALIDITY OF TICKETS The Liceu guarantees the authenticity of a ticket if it comes from an official point of sale (www.liceubarcelona.cat/ca/taquilles and www.liceuplus.cat). Otherwise, the Liceu declines any responsibility. The resale of tickets is forbidden. With regard to tickets for performances in one of the theatre's auditoriums, any ticket that is changed, damaged, suspected of forgery or illegally acquired will authorise the LICEU to deny the holder access to the auditorium. Having a full ticket in good condition is a condition for admission. The ticket must be kept until you leave the venue so that it can be shown to Liceu staff at any time.
PROVISION OF THE SERVICE I. FOR INDOOR SHOWS The provision of the service is subject to the following limits: i. When the show has already started, access to the hall will not be allowed until there is a break. ii. The hall has some locations with reduced visibility which are outlined in the map of locations in the ticket-purchase process. The characteristics of the seat are accepted at the time these conditions are accepted. iii. For performances during the Liceu's artistic season, minors’ attendance is regulated according to the type of performance. You will find complete information at: https://www.liceubarcelona.cat/ca/condicions-i-normativa. iv. The LICEU reserves the right of admission. The bearer of this ticket undertakes to comply with the requirements and security conditions of the venue. The LICEU is not responsible for the improper use of the facilities. Leaning over the floor railings or hanging or leaving any object on them is not allowed. v. The ticket holder undertakes to be respectful to the artists and the venue staff, as well as to switch off mobile phones and all types of electronic devices before entering the venue and not to eat, drink or smoke inside the venue. Animals may not enter the venue, except assistance dogs. vi. The LICEU accepts no responsibility for any loss, theft, deterioration, damage or harm caused to the bearer or their personal belongings while they are at the Liceu. vii. The ticket bearer gives his/her consent for his/her image to be recorded or reproduced for commercial or promotional purposes of the show and of the FUNDACIÓ GRAN TEATRE DEL LICEU. viii. Entering the site with any object that the LICEU considers dangerous or that is prohibited by current regulations is forbidden. To this end, the ticket holder authorises the LICEU to carry out any checks or searches of persons and possessions needed, in accordance with the Law, to verify that the access conditions are met. ix. In the performances by external promoters, compliance with their rules and the internal rules of the Liceu is obligatory. The Liceu does not accept any of the obligations or responsibilities of the external promoters. x. COVID-19 measures: while at the Liceu, spectators must comply with and respect the organisational and preventive measures established by the theatre to prevent the spread of COVID-19.
II. FOR PERFORMANCES IN THE HALL AND ON THE LICEU+LIVE PLATFORM: The provision of the service is subject to the following limits: xi. The LICEU reserves all image and intellectual property rights to the show. Taking photographs, filming or recording is forbidden. xii. The Liceu or the organiser, if circumstances so require, may change the dates, times, programmes and performers, as well as cancel the performance. Once the ticket has been purchased, it shall not be refunded or exchanged unless the performance is cancelled. Any complaint related to the performance, suspension, change or cancellation of the performance must be addressed to the LICEU by submitting the ticket through the channels indicated in section 15.

INTELLECTUAL PROPERTY The intellectual property rights of all works, performances, shows, images or texts made available to the public by the FUNDACIÓ GRAN TEATRE DEL LICEU are protected under the terms set out in the Spanish Law on Intellectual Property (LPI), Royal Legislative Decree 1/1996, dated 12 April 1996, which approves the revised text of the LPI. Spectators must comply with current regulations.
DATA PROTECTION The data controller of personal data is the FUNDACIÓ GRAN TEATRE DEL LICEU, with tax ID no. G-60754223, and tax domicile at La Rambla 51-59, 08002 Barcelona, email address rgpd@liceubarcelona.cat. The data shall be processed for the purpose of managing the ticket purchases for shows and subsequently managing the shows, as well as for commercial purposes subject to the acceptance of this consent. This includes, among other things, managing purchase services, ticket booking, capacity management and entrance control. It is understood that by completing and sending this or any other form included on the website, the user provides his/her personal data freely and voluntarily and expressly consents to and authorises the LICEU to collect and process them automatically, as they are needed to achieve the purposes and objectives outlined herein. The data shall be deleted when they are no longer needed for the purpose for which they were collected, provided that the LICEU is no longer legally obliged to keep them. Personal data shall be processed by LICEU and shall not be transferred to third parties except in compliance with a legal obligation. The processing of personal data is legitimised by the contractual relationship established through this purchase and shall be processed in accordance with the provisions of Regulation (EU) 2016/679 dated 27 April 2016 (GDPR); and Organic Law 3/2018, dated 5 December 2018, on the Protection of Personal Data and guarantee of digital rights and other applicable regulations. By contracting goods and/or services, the user acknowledges and accepts the Privacy and Cookies Policies. The user may exercise their rights of access, rectification, erasure, portability, restriction or objection to processing by sending a written communication to the FUNDACIÓ GRAN TEATRE DEL LICEU at the postal or e-mail address indicated herein. Furthermore, if the user believes that their rights have not been adequately addressed, they have the right to file a complaint with the oversight authority at apdcat.gencat.cat.
LIABILITY To the extent permitted by law, the LICEU will not be responsible under any circumstances for any liability arising from the contracting of the services, nor for any possible damage or harm caused by the unavailability of the services due to force majeure or errors in remote data transfer networks beyond its control (including, among others, viruses or other errors, flaws or malfunctions in computer transmissions or network communications). The LICEU shall not be responsible for changes due to programming circumstances, dates, schedules, programmes or performers announced. If the show is cancelled, the user has the right to request a refund of the amount paid, except in cases where the cancellation is due to unforeseen circumstances or force majeure. In this case, the user will not be entitled to a refund. The right to cancel does not apply to the purchase of tickets to cultural events and recreational activities or to the subscription to digital content. These types of products and services are exceptions that do not allow the exercise of this right. In any case, the FUNDACIÓ GRAN TEATRE DEL LICEU's liability with the user shall not exceed the total price charged for the contracted services.
CLAIMS Any complaint that the user considers appropriate will be dealt with as quickly as possible. Claims must be made to the persons responsible depending on the complaint or claim. APPLICABLE LEGISLATION AND JURISDICTION If any provision in this agreement is rendered invalid, illegal, ineffective or unenforceable, it will not affect the validity or enforceability of the remaining contractual provisions, which will continue to be valid and have legal effects as if the invalid, illegal, ineffective or unenforceable provision had not been part of this agreement. The relationship between LICEU and users shall be governed by the provisions of these Conditions. With regard to any matter not explicitly mentioned in these Conditions, the relationship shall be regulated by the applicable laws, in particular Law 7/1998, dated 13 April 1998, on general contracting conditions; Royal Legislative Decree 1/2007, dated 16 November 2007, which approves the revised text of the general law for the defence of consumers and users and other complementary laws; Law 22/2010, dated 20 July 2010, on the Consumer Code of Catalonia; Organic Law 3/2018, dated 5 December 2018, on the protection of personal data and the guarantee of digital rights; General Data Protection Regulation 2016/679 and Law 34/2002, dated 11 July 2002, on services of the information society and ecommerce. Consumers and users may resolve any dispute before the competent court according to their place of residence or at the LICEU's registered office. In the event that the LICEU initiates legal action with a consumer, the courts of the jurisdiction of the consumer's domicile will have jurisdiction. In all cases of commercial contracts, the parties agree to submit to the exclusive jurisdiction of the courts of Barcelona.
